These Terms of Service (“Terms”) apply to all users of the BarkOS mobile application (“App”) and related services (collectively, the “Service”). The Service is operated by DB8 Labs Inc., an Ontario corporation (“DB8 Labs”, “we”, “us”, “our”).

By downloading, accessing, or using the Service, you acknowledge and agree to these Terms. If you do not agree, do not use the Service. You confirm that you are 18 years of age or older and have the right and authority to agree to these Terms.

We may update these Terms periodically. Changes will take effect upon posting within the Service. Continued use means you accept the updated Terms.

Our collection, use, and disclosure of Personal Information is governed by our Privacy Policy.

BarkOS allows users to upload images of dogs and receive AI-generated interpretations of potential emotional states and behavioral cues (“Outputs”).

The Service is provided for entertainment and general informational purposes only. We do not guarantee accuracy, usefulness, or reliability of Outputs.

Outputs are not a substitute for professional veterinary care or certified dog behavior expertise. If you have concerns about your dog’s health or safety, consult a qualified professional.

Access to the Service requires an active paid subscription (“Subscription”).

• Subscription Fees (“Fees”) will be displayed at the time of purchase

• Fees must be paid in advance and are non-refundable except where required by law

• We may adjust pricing, with notice to you before renewal billing

• On renewal, the Subscription will continue automatically unless cancelled

• Payment processing is handled by third-party providers

• You can manage or cancel your Subscription at any time through your App Store account settings. If a Subscription is cancelled or expires, access to the Service and its features may be limited or disabled.

• Refunds for Subscriptions are managed directly through the App Store and are subject to  Apple’s refund policies. DB8 Labs does not process or issue refunds for purchases made through the App Store.

If payment fails, access may be suspended until resolved.

You may upload photos, text, and other media to the Service (“User Content”). You remain the owner of your User Content. You grant DB8 Labs a worldwide, royalty-free, transferable, sublicensable license to:

• store, process, reproduce, display, analyze, and create Outputs

• improve and develop the Service using anonymized and aggregated data

You represent that you have all necessary rights and permissions to upload User Content, including rights to images of pets and any individuals appearing in them.

You agree not to upload content that:

• you do not own or have legal rights to

• violates privacy, copyright, or other third-party rights

• is unlawful, harmful, abusive, pornographic, or otherwise objectionable

We may remove or block access to any User Content that violates these Terms.

Outputs may contain inaccuracies, biases, or unintended results. You are solely responsible for evaluating Outputs before relying on them. DB8 Labs does not provide:

• veterinary advice

• behavioral training advice

• emergency instructions

• diagnosis, treatment, prescriptions, or sedation recommendations

• assurances regarding your dog’s health, temperament, or aggression risk

Outputs are generated by artificial intelligence based on pattern recognition and are not scientifically validated. Any interpretation provided by BarkOS reflects generalized behavioral observations and should not be treated as fact.

You agree not to rely on the Service to make decisions affecting your dog’s health, safety, care, or behavior. Do not rely on BarkOS to assess or manage dangerous behavior. Always supervise your dog.

The Service, including software, trademarks, text, graphics, and other materials, is owned by DB8 Labs or our licensors. We provide you a limited, non-exclusive, revocable license to use the Service for personal, non-commercial purposes. Nothing in these Terms transfers ownership rights to you.

You agree not to:

• interfere with or disrupt the Service

• reverse engineer, decompile, modify, or copy the Service

• use the Service for illegal, harmful, or deceptive purposes

• attempt to access accounts or systems without authorization

• upload viruses or malicious code

We may suspend or terminate your access if we suspect misuse.

The Service may be modified, suspended, or discontinued at any time without liability. We do not guarantee continuous or uninterrupted access.

THE SERVICE AND ANY OUTPUTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. DB8 LABS DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

• ACCURACY OR RELIABILITY OF OUTPUTS

DB8 LABS DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES.

To the fullest extent permitted by law:

DB8 LABS, ITS AFFILIATES, LICENSORS, SUPPLIERS, AND DIRECTORS WILL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

• LOSS OF DATA, PROFITS, OR GOODWILL

• ANY CLAIM ARISING OUT OF OR RELATED TO USE OF THE SERVICE OR OUTPUTS

Our total cumulative liability will not exceed the greater of:

• $50 CAD

• The amount you paid to DB8 Labs in the 12 months preceding the claim

Some jurisdictions do not allow these limitations, so they may not apply to all users.

You agree to defend and indemnify DB8 Labs against any claims, damages, losses, or expenses (including legal fees) arising from:

• Your User Content

• Your misuse of the Service

• Your violation of these Terms or third-party rights

This section applies to users located in the United States.

To resolve disputes efficiently:

• You and DB8 Labs agree to binding arbitration

• Conducted individually, not as a group or class

• class action lawsuits or class-wide arbitration are waived

Some claims may be resolved in small claims court if qualified.

Details on arbitration procedures will be made available upon request.

For users in Canada and outside the U.S.:

• These Terms are governed by the laws of the Province of Ontario, Canada

• Courts located in Ontario have exclusive jurisdiction

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You may stop using the Service at any time. DB8 Labs may suspend or terminate access:

• if these Terms are violated

• for legal, business, or security reasons

Upon termination, licenses granted to you will end, and User Content may be removed or deleted.

• These Terms are the entire agreement between you and DB8 Labs

• If any provision is found invalid, the remainder stays in effect

• DB8 Labs may assign its rights without notice

• Failure to enforce a provision does not waive it

• Notices may be provided electronically
